- The Store Manager does not supervise more than two full time employees that work at least 80 hours per week; or
- The Store Manager is not involved in hiring or firing or making recommendations for hire or fire that are given particular weight; or
- The Store Manager’s primary duty is not the performance of managerial duties, but instead is the performance of tasks and routine associate/clerical/physical matters or tasks that are controlled by strict policies/procedures or directives from supervisors

Note: Even if you are properly classified as exempt, you may be misclassified as exempt if your employer requires you to “train” for your position and you work more than 40 hours during that training and are not paid overtime.
